This Website is operated by MP Food Ltd ("Monty's", "we", "us" or "our"), trading as Monty's.

2. Acceptance of these Terms

By using this Website or placing an order, you confirm that you accept these Terms and that you agree to comply with them. If you do not agree, please do not use the Website or place an order.

These Terms apply in addition to any specific terms that apply to a particular order (for example, catering terms confirmed at the time of booking). Where there is a conflict, the specific order terms will take precedence for that order.

3. Using our Website

You may use our Website for lawful purposes only. You agree not to:

  • use the Website in any way that breaches any applicable law or regulation;
  • use the Website in any way that is unlawful or fraudulent, or that has any unlawful or fraudulent purpose or effect;
  • attempt to gain unauthorised access to the Website, the server on which it is stored, or any server, computer or database connected to it;
  • introduce viruses, malware, or any other material that is malicious or technologically harmful; or
  • reproduce, copy, or resell any part of the Website except as permitted by these Terms.

We do not guarantee that the Website, or any content on it, will always be available or be uninterrupted. We may suspend, withdraw, or restrict all or part of the Website for business or operational reasons without notice.

4. Intellectual property

All content on this Website — including text, logos, branding, the Monty's name, recipes, photographs, graphics, video, and page layout — is owned by us or our licensors and is protected by copyright, trade mark, and other intellectual property laws.

You may view and print pages from the Website for your own personal, non-commercial use. You may not otherwise copy, reproduce, republish, distribute, or exploit any content without our prior written permission.

5. Menu, allergens & food information

We take food safety and allergen information seriously.

  • Menu items, ingredients, and availability may change without notice, and images are for illustration only.
  • Our food is prepared in a kitchen that handles allergens including (but not limited to) cereals containing gluten, eggs, fish, milk, nuts, peanuts, sesame, soya, mustard, celery, sulphites, molluscs, crustaceans, and lupin. We cannot guarantee that any item is completely free from any allergen, as cross-contamination may occur.
  • If you have a food allergy, intolerance, or dietary requirement, please tell a member of our team before ordering so we can advise you. For orders placed through third-party platforms or our catering system, please make your requirements clear at the point of ordering and contact us to confirm.
  • Nutritional and allergen information provided on the Website is offered in good faith and to the best of our knowledge, but it is your responsibility to check with us if you are unsure.

6. In-store & collection orders

Orders placed in person at our Bankside site are subject to availability and our published opening hours. Prices are as displayed in store at the time of ordering.

7. Delivery via third-party platforms

Delivery orders are fulfilled through independent third-party platforms (for example, Deliveroo). When you order through one of these platforms:

  • your order and delivery are also subject to that platform's own terms and conditions and privacy policy;
  • pricing, service fees, delivery charges, delivery times, and refund or cancellation policies are set and managed by the platform and may differ from those that apply in store; and
  • any issues relating to delivery (such as delivery time, driver conduct, or order tracking) should be raised with the relevant platform in the first instance, though we are always happy to help where we can.

We are not responsible for the acts or omissions of third-party delivery platforms or their drivers.

8. Catering orders

We offer catering for advance orders placed through our online catering system or by contacting us directly.

  • Placing an order: Catering orders are subject to availability and confirmation by us. An order is only confirmed once we have accepted it and, where applicable, received payment or an agreed deposit.
  • Lead times: Catering requires advance notice. We will confirm the required lead time and any minimum order values at the time of ordering.
  • Amendments: Requests to change an order (quantities, items, delivery time, or address) should be made as early as possible and are subject to our acceptance and to any applicable cut-off times.
  • Cancellations: Because catering is prepared to order, cancellation charges may apply depending on how much notice you give. Our cancellation and refund terms for a given order will be confirmed to you at the time of booking.
  • Delivery or collection: Catering can be collected from our site or delivered by arrangement. Delivery charges, areas, and timings will be confirmed when you order.

9. Prices & payment

  • All prices are shown in pounds sterling (£) and, where we are VAT registered, are inclusive of VAT unless stated otherwise.
  • We take reasonable care to ensure prices are correct, but errors can occur. If we discover an error in the price of an order you have placed, we will contact you to confirm whether you wish to proceed at the correct price or cancel.
  • Payment must be made using the methods offered at the point of ordering. For catering, payment terms (including any deposit) will be confirmed at the time of booking.

10. Cancellations, refunds & your consumer rights

Nothing in these Terms affects your statutory rights as a consumer, including your rights under the Consumer Rights Act 2015.

Please note that under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, the standard 14-day "cooling-off" right to cancel does not apply to certain orders, including:

  • perishable food and drink; and
  • the supply of catering or other services for a specific date or period.

This does not affect your right to a refund or remedy where food or a service is faulty, not as described, or not of satisfactory quality. If something is wrong with your order, please contact us as soon as possible and we will put it right in line with your legal rights.

11. Availability & changes to our offering

Our menu, opening hours, service areas, and the products and services we offer may change from time to time. We will make reasonable efforts to keep the Website up to date, but we do not warrant that all information is complete, current, or error-free at all times. Please check with us directly if anything is time-sensitive.

12. Links to other websites

Our Website may contain links to third-party websites and platforms (for example, delivery platforms, social media, and mapping services). These links are provided for your convenience only. We have no control over the content of those sites and accept no responsibility for them or for any loss or damage that may arise from your use of them.

13. Disclaimers & limitation of liability

Nothing in these Terms excludes or limits our liability where it would be unlawful to do so. This includes liability for:

  • death or personal injury caused by our negligence;
  • fraud or fraudulent misrepresentation; and
  • any matter for which it would be unlawful for us to exclude or attempt to exclude our liability, including your statutory rights as a consumer.

Subject to the above, we do not accept liability for any loss or damage that is not reasonably foreseeable, or for any business losses (as our products and services are supplied for domestic and private use).

The Website and its content are provided on an "as available" basis. We make no warranties that the Website will be uninterrupted, secure, or free from errors or viruses, and we are not responsible for any loss or damage caused by a distributed denial-of-service attack, viruses, or other technologically harmful material that may infect your equipment through your use of the Website.

16. Governing law & jurisdiction

These Terms, their subject matter, and their formation are governed by the law of England and Wales. You and we both agree that the courts of England and Wales will have exclusive jurisdiction, except that if you are a consumer resident elsewhere in the UK, you may also bring proceedings in your home jurisdiction.
